The Commission Implementing Regulation (EU) 2019/947 entered into force last December 31, 2020. This new drone regulation transition makes a more inclusive framework for drone operations, ensuring and improving safety, security and sustainability.

If you currently manufacture or fly drones, the new drone regulation transition will be of your interest to. According to AESA, the Spanish Aviation Authority, this is the transition period established to implement the new regulation.

Registration:

 

UAS operators residing, if they are physical people or having the main activity centre, or if they are legal people in Spain must register telematically in the AESA’s platform when:

1. They use any unmanned aircraft in the ‘’open’’ category:

  • With MTOM =250g up to 25kg, there is the possibility of transferring kinetic energy greater than 80J to a person in case of collision.
  • Equipped with a sensor capable of capturing personal data unless it complies with Directive 2009/48/EC («Toys Directive»).

2. Operate an unmanned aircraft of any mass in the ‘specific’ category.

 

Authorizations, prior communications, and pilot certificates: 

Operational authorizations granted, and prior communications submitted based on Royal Decree 1036/2017 shall remain valid until 1 January 2022.

Basic or advanced certificates and practical remote pilot certificates issued under Law 18/2014 or Royal Decree 1036/2017 shall remain valid until 1 January 2022. Before that date, they shall be converted under Commission Implementing Regulation (EU) 2019/947.
