The rules governing the affixing of the CE marking for UAS intended to be operated according to Commission Implementing Regulation (EU) 2019/947 are laid down in Commission Delegated Regulation (EU) 2019/945. According to this regulation, CE Marking is the consequence of a conformity assessment process whose principles are set out in Regulation (EC) No 765/2008.

The first step to affix the CE Marking for UAS is to identify the applicable Directives and Harmonized Standards, bearing in mind that we should follow Commission Delegated Regulation (EU) 2019/945. The following steps are dedicated to deciding which conformity assessment procedure to use (Module A, Module B+C, Module H, etc.)

After these steps have been taken, an integral product conformity assessment will occur. This procedure consists of carrying out different types of tests both in the laboratory environment and in flight. Some of these tests are maximum speed and height, geofencing, C2 link loss, sound power level, etc.

Depending on the conformity assessment procedure, this assessment shall be carried out by a Notified Body. According to the European Commission, a notified body is an Organisation designated by an EU country to assess the conformity of certain products before being placed on the market. These bodies carry out tasks related to conformity assessment procedures set out in the applicable legislation, when a third party is required. A Notified Body must be independent of the organization it assesses, and it shall be capable of carrying out the conformity assessment task assigned to it.

Once the tests have been successfully executed, and the conformity assessment procedure is over, the manufacturer can affix the CE Marking, which in some cases shall be followed by the identification number of the notified body.

When all the activities are done, the drone may be placed in the market in the EU.
